The format varies per event. Each event will be played under the USGA rules of golf. Each person's registration fee covers 18 holes of golf, breakfast, lunch, drinks, a gift, par 3 challenges, and more.

EVENT TERMS AND CONDITIONS

General Event Overview: Kahuna Golf is a series of golf events that happen throughout the year. The events are open to all golfers 21 years or older. The course date and start time are subject to change.

Eligibility and Rules of Golf:  An official USGA-sanctioned handicap is required to participate, and you must provide your GHIN Number upon request. Employees of Kahuna Golf and persons working in any capacity at the local events are ineligible for prizes. Participants assume personal responsibility for ensuring that their amateur status under PGA/USGA rules is not adversely affected by participation in these events. Play is governed by the current USGA Rules of Golf, local rules for each course, and any Kahuna Golf rules. Local rules and Kahuna Golf rules will be provided by each course and Kahuna Golf and will be available on-site upon requests. Questions with respect to the rules of golf, local rules and Kahuna Golf rules, and scoring will be settled by a Kahuna Golf representative presiding over the event, whose decision will be final.

Entries/Registration Fees: Space for each local event is limited, and entries will be accepted on a “first come-first served” basis. Registration fees are non-refundable, non-transferable, and all sales are final. Your registration is a license to attend a specific event you have purchased the ticket for, and such license can be revoked at any time if any of these Terms & Conditions or any host golf course code of conduct are violated by Participant.

Participant Obligations and Acknowledgements: Participant is required to provide true, accurate, complete, and current information about themselves and their USGA handicap and information related thereto.

Participant acknowledges that Kahuna Golf has the right to suspend, refuse access to, or refuse to pay any potential prize money if it is determined that Participant has provided inaccurate, untruthful, or misleading information about themselves or their USGA handicap, or has violated these Terms and Conditions in any manner whatsoever.

Cash prizes are void where prohibited.

Each Participant winner shall be solely responsible for reporting and paying any and all applicable taxes relating to the prize.

Any Participant winning over $600 in prize winnings will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

Equipment: Participant shall be responsible for providing their own equipment, and Kahuna Golf cannot make any representation or guarantee that any course will provide equipment available for rent.

Event Cancellation & Inclement Weather Policy: Kahuna Golf will make best efforts to play the event on the scheduled date. If the host course, or Kahuna Golf, in its sole discretion, needs to cancel play due to inclement weather, the event may be canceled or rescheduled for a rain date.

Kahuna Golf shall not be responsible for any incidental costs (travel, lodging) occurring as a result of inclement weather.

PUBLICITY RELEASE: Except where prohibited, an entrant’s participation in any Kahuna Golf event constitutes consent to the worldwide, royalty-free use of his/her name, photo, and/or likeness, biographical information, entry, and statements attributed to him/her by Kahuna Golf for promotional purposes, including without limitation, inclusion on the Kahuna Golf website, or other Kahuna Golf websites or apps, in its e-mail communications and any other media chosen by Kahuna Golf without compensation.

PRIVACY AND PERSONAL INFORMATION: Kahuna Golf may collect personal data about participants online and use such data in accordance with Kahuna Golf’s privacy policy at https://www.kahunagolf.io/privacy-policy (“Privacy Policy”) and as set forth in these Terms and Conditions. Please review these Terms and Conditions and the Privacy Policy carefully. By participating in Kahuna Golf events, participants hereby agree to such collection and use of their personal information by Kahuna, either collectively or individually, and acknowledge that they have read and accepted these Terms and Conditions and the Privacy Policy.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY: (A) PARTICIPANT AGREES THAT THEIR REGISTRATION, ATTENDANCE, AND PARTICIPATION IS AT PARTICIPANT’S SOLE RISK. NEITHER KAHUNA GOLF, ITS AFFILIATES OR PARENT COMPANIES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, SPONSORS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS MAKE ANY WARRANTIES OR REPRESENTATIONS WHATSOEVER, OR AS TO THE ACCURACY OR RELIABILITY OF ANY CONTENT, INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH KAHUNA GOLF. KAHUNA GOLF, AND ANY PRODUCTS AND/OR SERVICES PROVIDED THEREWITH ARE PROVIDED ON AN "AS IS" AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.

(B) NEITHER KAHUNA GOLF, ITS AFFILIATES OR PARENT COMPANIES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS SHALL BE LIABLE REGARDLESS OF THE CAUSE OR DURATION, FOR ANY ERRORS, INACCURACIES, OMISSIONS, OR OTHER DEFECTS IN, OR UNTIMELINESS OR INAUTHENTICITY OF, THE INFORMATION RELATING TO THE BARSTOOL CLASSIC, OR FOR ANY CLAIMS OR LOSSES ARISING THEREFROM OR OCCASIONED THEREBY. IN NO EVENT WILL ANY OF THE FOREGOING PARTIES BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE REGISTRATION, ATTENDANCE, AND/OR PARTICIPATION IN THE BARSTOOL CLASSIC, INCLUDING WITHOUT LIMITATION ANY TRAVEL RELATED THERETO, OR AS A RESULT OF ANY PRIZE, OR ACCEPTANCE, POSSESSION, OR USE OF ANY PRIZE.

(C) PARTICIPANT AGREES THAT NEITHER KAHUNA GOLF, ITS AFFILIATES OR PARENT COMPANIES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, SPONSORS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS ARE LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER PARTICIPANTS OR THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH PARTICIPANT.

These Terms and Conditions and any Event rules for Kahuna Golf established by constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. This Agreement shall be construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of laws rules. Participant and Kahuna Golf agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Hillsborough, Tampa, Florida. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import. In the event a court of competent jurisdiction finds that any provision of these Terms of Use is invalid, the court should give effect to the parties' intentions as reflected in the provision, and all other provisions of these Terms of Use shall remain in full force and effect. All rights not expressly granted to Participant herein are hereby reserved to Kahuna Golf and its affiliates.
